Tiktok Legal Policy

Retention requests must be sent on law enforcement letterhead, signed, and uniquely identify the specific user data to be retained (by reference to username, data type, and date ranges as described in Section 3 above). TikTok will retain the information for an additional period of 90 days upon receipt of a formal request for extension of retention. We cannot consider multiple renewal requests beyond an additional 90-day period. It`s possible that the changes to TikTok`s privacy policy are in response to a recent national class-action lawsuit filed against the company, in which it agreed to pay $92 million to plaintiffs alleging various data breaches. As we reported on the case in February, “As part of the settlement, TikTok has agreed to avoid several behaviors that could compromise users` privacy, unless it explicitly discloses such behavior in its privacy policy.” However, when asked if these changes were a response to the class action lawsuit, TikTok declined to comment on the records. We ensure that TikTok does not allow activities that violate laws or regulations. We prohibit the trade, sale, promotion and use of certain regulated goods, as well as the representation, promotion or facilitation of criminal activity, including the exploitation of human beings. Content may be removed if it relates to regulated or illegal activities or goods in the majority of the region or world, even if the activities or goods in question are legal in the publishing jurisdiction. If you are accessing or using the Services on behalf of a company or entity, (a) “you” and “your” include you and that company or entity, (b) you represent and warrant that you are an authorized representative of the company or entity having the authority to bind the Company to these Terms; and that you are accepting these Terms on behalf of the Company, and (c) your company or entity is legally and financially responsible for your access to or use of the Services, as well as the access to or use of your account by others associated with your company, including employees, agents or contractors. We are strongly committed to ensuring the safety of minors on our platform. We do not tolerate activities that perpetuate abuse, harm, endangerment, or exploitation of minors on TikTok.

Any content, including animations or digitally created or manipulated media that depict abuse, exploitation or nudity of minors, constitutes a violation on our Platform and will be removed as soon as it is detected. If warranted, we will report infringing content to the National Center for Missing & Exploited Children (NCMEC) and/or other appropriate law enforcement authorities. TikTok considers a minor to be anyone under the age of 18. In any case, there are also cases where we need to keep your data longer in accordance with our legal obligations or if this is necessary for legal claims. What are the legal bases for data processing? When we process your personal data, we rely on your consent, the performance of a contract, our legitimate interest and our obligations to process personal data where required by law. Harmful activities of minors include possession or use of substances prohibited to minors, abuse of legal substances, participation in illegal activities, participation in activities, physical challenges or courage that may endanger the well-being of minors. We remove this content from our platform. We review User Content for content moderation purposes in order to enforce our Community Guidelines, comply with legal obligations, and prevent and respond to abuse, fraud, illegal activities, and other potentially harmful content on the Platform. In the event of any conflict between the provisions of the Additional Terms – specific to the jurisdiction from which you access or use the Services and the rest of the Policy, the additional terms of those jurisdictions – shall prevail and control. Any acknowledgement of receipt of correspondence is for convenience only and TikTok does not waive any right to object (including lack of jurisdiction, invalid legal process, or proper delivery).
